Charge: Concealed Weapon: Carry While Intoxicated as defined in 18.2-308.012(A). Result: New case law was presented to the prosecutor who was not familiar with the relevant case. Once reviewed, the prosecutor agreed to dismiss the case by Nolle Prosequi. This charge arose from a DWI/DUI case.

DWI Dismissed by Nolle Prosequi
Charge: DUI/DWI, First Offense. Result: DUI/DWI, First Offense Dismissed by Nolle Prosequi after negotiation with the prosecutor. This result was particularly important for client as client was a well-known dentist who needed to maintain a clean record for professional insurance reasons.

Reckless Driving by Speed Dismissed
Charge: Reckless Driving by Speed (96 miles per hour in a 65 miles per hour zone). Result: Dismissed. Client was a professional driver and needed this result to maintain her ability to drive for a living. The firm previously represented the client in another matter.

Reckless Driving by Speed Dismissed
Charge: Reckless Driving by Speed (89 miles per hour in a 70 miles per hour zone) as defined in Code Section 46.2-862. Result: Dismissed upon the payment of court costs. Client contacted the firm again for representation in Goochland General District Court.

Reckless Driving by Speed (95mph/65mph) Reduced to Regular Speeding Infraction
Goochland GDC - Charge: Reckless Driving by Speed (95mph in a 65 mph zone). Result: Reckless Driving Reduced to Speeding (84 mph in a 70 mph zone) with a $120.00 fine.

DWI, 2nd Offense Reduced to Reckless Driving
Hanover GDC - Charge: DWI, 2nd Offense within 5 to 10 years. Result: DWI, 2nd Offense Reduced to Reckless Driving as defined in Code Section 46.2-852 (Reckless Driving Generally). The Court did not impose a suspended jail sentence, a suspended driver's license, or ASAP.

DWI, BAC 0.20% Involving Accident Reduced to Reckless Driving
Charge: DWI, 1st Offense, BAC 0.20%. Result: DWI, 1st Offense with elevated BAC (more than three times the legal limit) Reduced to Reckless Driving as defined in Code Section 46.2-852 (Reckless Driving Generally). Client was active military and may have faced additional consequences if convicted as charged.

DWI Involving Serious Accident Reduced to Reckless Driving
Chesterfield GDC - 2 Charges: (1) DWI, First Offense. Result: DWI, First Offense Reduced to Reckless Driving. The initial offer from the prosecutor was a standard first DWI conviction. (2) Failure to Appear (Show Cause). Result: Dismissed.

Fail to Stop at the Scene of an Accident Dismissed by Nolle Prosequi
Charge: Fail to Stop at the Scene of an Accident as defined in Code Section B.46.2-894. Result: Dismissed by Nolle Prosequi. Client was active military who was concerned about how a conviction may impact his military career. Client was required to pay restitution after which the case was dismissed.
